Brazil’s SPA Has Openly Criticised a Blanket Ban on iGaming Advertising

SPA’s position underscores the risk that outright prohibitions could hinder regulatory progress, potentially driving audiences back towards unlicensed operators rather than fostering a safer, more transparent environment.

Supervisory Body’s Opinion on Restrictions

The authority’s representatives expressed their concerns regarding the possible ramifications of enacting Bill No. 3563/2024.

If sanctioned, the initiative will result in modifications within the following areas:

1. Classic and online media marketing. Commercials on television, radio, magazines, newspapers, posters, and digital platforms will be prohibited. Advertisements on gambling apps for mobile phones, tablets, and smart TVs will also be banned.
2. Sports sponsorships. Clubs, federations, and stadiums will no longer be allowed to place gambling brand logos on uniforms or billboards. Funding for public or cultural events will also be subject to restrictions.
3. Collaboration with influencers. iGaming marketing on social media through celebrities’ accounts and online content creators’ streams will be outlawed.

The supervisory body’s members warned that such extreme measures would hinder certified business owners from competing effectively against the grey segment. They highlight that, without legitimate options available across accessible web and offline channels, gamblers are likely to turn to unregulated brands, unable to differentiate them from licensed offers.

SPA’s Plans for Market Oversight

Following criticism of government decisions, the Secretariat suggested shifting the emphasis away from outright bans towards strengthening control measures and detecting existing violations. The organisation’s team stressed that blocking sanctioned products should remain a primary focus. In the 1st year of Brazil’s regulated gambling market operation, more than 25,000 domains were shut down.

Concurrently, the authority plans to intensify oversight of influencer activities, with particular attention to advertising involving foreigners. Currently, a top priority is monitoring sportsbook services’ compliance ahead of key athletic events.
